The third and final individual charged by the Serious Fraud Office after $3.5 million worth of Auckland construction contracts were allegedly awarded through bribery and corruption has been named.

The Serious Fraud Office (SFO) filed charges in December 2023 against a former project manager and two associates, including corruption of an official, corrupt use of official information and obtaining by deception.

In May, two of the three individuals who had charges filed against them were named as former project manager Daud Suryantyo and the former director of Trinity Construction Limited, Henry Rogo.

The third defendant who also pleaded not guilty in June alongside Suryantyo and Rogo can now be named as Milosi Toala after his name suppression was lifted.

Toala faces eight charges; six charges of obtaining by deception and two charges of corrupt use or disclosure of official information.

It is alleged that Toala, Suryantyo and Rogo acted together to obtain construction contracts from Regional Facilities Auckland and later, the Counties Manukau District Health Board.

It is alleged that the three defendants had personal and business relationships which they disguised from the public bodies and that Suryantyo benefited personally including through receiving bribes.

“The Serious Fraud Office would like to acknowledge Regional Facilities Auckland (now part of Tātaki Auckland Unlimited Limited) for bringing this matter to the Serious Fraud Office’s attention following their own internal investigation, and both Regional Facilities Auckland and the Counties Manukau District Health Board (now Te Whatu Ora Counties Manukau) for their assistance,” it said.

Around $3.5m in public funds was alleged to have been granted to the two companies.

The next court fixture on this matter was a trial callover in December.
